By accessing or using Pulse services ("Services"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Services. These Terms apply to all users, including browsers, vendors, customers, merchants, and contributors of content.

Permission is granted to temporarily access and use Pulse Services for personal, non-commercial transitory viewing and business operations only. This is the grant of a license, not a transfer of title, and under this license you may not: • Modify or copy the materials • Use the materials for any commercial purpose outside of licensed business operations • Attempt to decompile or reverse engineer any software contained within Pulse • Remove any copyright or other proprietary notations from the materials • Transfer the materials to another person or "mirror" the materials on any other server This license shall automatically terminate if you violate any of these restrictions and may be terminated by Pulse at any time.

To access certain features of the Services, you must register for an account. When you register, you agree to: • Provide accurate, current, and complete information • Maintain and promptly update your account information • Maintain the security of your password and accept responsibility for all activities under your account • Notify us immediately of any unauthorized use of your account Pulse reserves the right to suspend or terminate accounts that violate these terms.

Pulse strives to maintain high service availability but does not guarantee uninterrupted access. We may: • Perform scheduled maintenance with advance notice where possible • Implement emergency maintenance without notice if required for security or stability • Modify, suspend, or discontinue any aspect of the Services We are not liable for any modification, suspension, or discontinuance of the Services.

Your use of Pulse Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of information as detailed in the Privacy Policy. You retain ownership of your data. You grant Pulse a license to use, process, and store your data solely to provide and improve the Services.

The Services and their original content, features, and functionality are owned by Pulse and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks may not be used in connection with any product or service without prior written consent from Pulse.

If you purchase a subscription or services: • You agree to pay all fees associated with your selected plan • Fees are non-refundable except as expressly stated in these Terms • We may change fees upon 30 days notice • You authorize us to charge your payment method on a recurring basis • Failure to pay may result in suspension or termination of your account

You may not use the Services: • In any way that violates applicable laws or regulations • To transmit harmful code, viruses, or malicious software • To attempt to gain unauthorized access to any systems or networks • To harass, abuse, or harm another person • To collect user information without consent • To interfere with or circumvent security features • For any purpose that is unlawful or prohibited by these Terms

In no event shall Pulse, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: • Your access to or use of or inability to access or use the Services • Any conduct or content of any third party on the Services • Any content obtained from the Services • Unauthorized access, use, or alteration of your transmissions or content Our total liability shall not exceed the amount paid by you, if any, for accessing the Services during the twelve months prior to the claim.

You agree to defend, indemnify, and hold harmless Pulse and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: • Your use of and access to the Services • Your violation of any term of these Terms • Your violation of any third-party right, including intellectual property rights • Any claim that your content caused damage to a third party

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts in San Francisco, California.

We reserve the right to modify or replace these Terms at any time. Material changes will be notified at least 30 days before taking effect. By continuing to access or use our Services after revisions become effective, you agree to be bound by the revised terms.
